US stocks are modestly lower mid-day on weakness in technology shares and rising long-term interest rates. Japanese shipbuilders are facing delays of 20 days for steel plates amid high prices for the metal, Lloyd’s List reported. Mattel and closely held MGA Entertainment plan to pit rival dolls against each other with new products that cast the characters as rock stars or actresses, the Wall Street Journal said. New England Lobsters may soon become a rarity on dinner plates after the species was hit by a shell-rotting disease, the AP said. Thomas Weisel Partners LLC, a closely held San Francisco-based investment banking firm, is preparing an IPO, the NY Post reported. Eastman Kodak and French cell-phone company SFR reached an agreement to enable SFR users to print photos from their wireless phones beginning in May, Reuters reported. Dendreon Corp.’s Provenge prostate cancer vaccine showed promise in a recent late-stage clinical study, including 34% of men using the vaccine living three years with the cancer, the NY Times reported. OAO Yukos Oil may close down its three main divisions on May 3 to protect the company from tax and legal authorities, Interfax said. Amgen’s experimental drug helped patients with Parkinson’s disease enrolled in a University of Kentucky study, the LA Times reported. Harvard University’s embryonic stem cell research and the school’s plans to create cloned human embryos didn’t violate state law, the Boston Globe reported. Wynn Resorts Chairman Wynn has bought 4% of the shares of slot-machine maker WMS Industries because he likes the company’s products, the Las Vegas Sun reported. Wal-Mart Stores said fourth-quarter profit rose 16% on fewer holiday discounts and lower merchandise costs, Bloomberg reported. Members of the United Iraqi Alliance debated their choice for the next prime minister as Iraq’s electoral commission certified the results of the Jan. 30 poll for a National Assembly that gave the Shiite Muslim coalition nearly half of the votes, Bloomberg said. The number of Americans filing first-time claims for unemployment insurance unexpectedly declined last week to the lowest level in more than four years, Bloomberg reported. Pfizer’s Celebrex painkiller probably poses risk of heart attacks at high doses, said FDA reviewer David Graham at a hearing today on the safety of pain medicines, Bloomberg reported. The index of leading US economic indicators declined .3% in January, the first drop in three months, as consumer confidence lagged and stock prices slumped, Bloomberg said. Manufacturing in the Philadelphia area expanded at a quicker-than-expected pace this month, Bloomberg reported.

BOTTOM LINE: The Portfolio is lower mid-day on losses in my internet, software and RFID longs. I have not traded today, thus the Portfolio remains 100% net long. The tone of the market is weaker as the advance/decline line is negative and most sectors are lower. However, volume is relatively light and measures of investor anxiety are mostly higher. Cyclicals are outperforming and technology stocks are underperforming. Greenspan’s testimony mainly centered around Social Security reform and gave little insight into current US economic conditions. I expect US stocks to trade mixed-to-higher from current levels into the close on good earnings reports, lower energy prices, strong economic reports and short-covering.

Late-Night News
Asian indices are mostly lower on declines in technology shares in the region and worries over higher energy prices. Matlin Patterson Global Advisers LLC, a US-based buyer of distressed assets, agreed to buy South Korea's Orion Electric for $117 million, Maeil Business Newspaper reported. United Microelectronics shares fell after a report said Vice Chairman John Hsuan must remain in Taiwan for a government probe into the world's second-largest made-to-order chip supplier's ties to a Chinese company, Bloomberg reported. An Israeli military committee has recommended ending the policy of demolishing Palestinian homes used by suspected terrorists, Haaretz reported. US negotiator Chris Hill will visit China this week amid attempts to persuade North Korea to return to six-party talks on dismantling the nation's nuclear weapons program, Xinhua news agency reported. China's influence over N. Korea will be the key to quickly restarting talks on dismantling the communist nation's nuclear weapons program, Japan's Foreign Minister said. Philadelphia officials have proposed giving every resident high-speed Internet access by turning the city into a wireless hot spot, the NY Times said. Domino's Pizza is focusing on hiring better store managers and giving them stock options and promotions to help reduce turnover, the Wall Street Journal reported. Dolby Laboratories raised $495 million in an IPO, making founder Ray Dolby a billionaire, Bloomberg reported. Quadrangle Group LLC, the buyout firm founded by former Lazard LLC partners including Steven Rattner, is seeking to raise about $1.3 billion for its second media and communications fund, Bloomberg said. Sepracor, which developed the Lunesta sleeping pill approved by the FDA in December, hired Morgan Stanley to advise it on "strategic options" that may include a sale, Bloomberg reported.

US stocks finished mostly unchanged today as rising energy prices and interest rates offset more optimism over US economic growth. After the close, Microsoft released an update of its Windows Media Player that it says will protect computers from a known spyware infection, eWeek reported. Ukraine’s new government plans to review the privatization of 3,000 companies by the previous administration, Bloomberg reported. Pennsylvania Senator Arlen Specter, the Republican chairman of the Senate Judiciary Committee, has Hodgkin’s Disease, a cancer of the lymph system, Fox News reported. Federal Reserve Chairman Alan Greenspan said today that he supports creating private Social Security accounts if they are gradually phased in to gauge the financial markets’ reaction, Bloomberg said. MGM Mirage, the casino operator controlled by billionaire Kirk Kerkorian, won US antitrust clearance to acquire Mandalay Resort Group for $4.8 billion without having to sell any Las Vegas casinos, Bloomberg reported. The US House of Representatives passed a bill to raise the maximum fines against broadcasters that air indecent material to as much as $500,000 for each violation, Bloomberg reported. Hewlett-Packard, a week after ousting CEO Fiorina for failing to produce the results she promised, said first-quarter profit was little changed as sliding printer income offset rising personal computer earnings, Bloomberg said. A ruling that barred the US from seeking $280 billion in past profits from the tobacco industry will be appealed to the full membership of a federal appeals court, the Justice Dept. said.

BOTTOM LINE: The Portfolio finished higher today on gains in my semi/software longs and internet shorts. I exited a tech long in the afternoon and added ZEUS long, thus leaving the Portfolio 100% net long. I am using a $22 stop-loss on this new position. The tone of the market improved slightly into the close as the advance/decline line finished nearly unchanged, sector performance was mixed and small-cap stocks were mostly higher. On the negative side, technology stocks underperformed and measures of investor anxiety were mostly mixed. The fact that the major indices didn’t fall today despite worries over relations with Iran, rising interest rates, increasing energy prices and tech stock earnings is a psychological positive. I still plan to increase the Portfolio’s market exposure on a clear break above the 2100 level on the Nasdaq, which I expect in the near future.

US stocks are modestly lower mid-day on worries over higher-interest rates and energy prices. Ubisoft Entertainment SA, a French video games maker, is in talks with Electronic Arts, two months after attacking the US company's purchase of a 20% stake as hostile, the Wall Street Journal reported. Mercora Inc., a closely held company based in Santa Clara, is pioneering so-called "peer-to-peer" radio that allows on-line music sharing without breaking the law, the Wall Street Journal reported. Time Warner plans to start a new series of cartoons based on its classic Looney Tunes characters to boost revenue at its animated franchises, the Wall Street Journal reported. Cerus Corp., a US biotech company specializing in blood-disease therapy, may be an investment opportunity, the Wall Street Journal reported, citing Anthony Marchese, of Insiders Trend Fund LP. Airbus SAS has signed an agreement that will give customers of its A380 airplane the option of installing equipment that would let passengers make calls using their own mobile phones, the AP reported. China will impose quotas on iron ore imports from March, Reuters reported. The race to be prime minister of Iraq has narrowed to Ibrahim Jafari of the Dawa Party and onetime US Pentagon favorite Ahmad Chalabi of the Iraqi National Congress, the NY Times reported. The International Association of Chiefs of Police will issue a notice to police departments within 10 days to look into the use of stun guns after numerous deaths that may be related to the weapon, USA Today reported. OPEC said oil demand will rise faster than expected this year, as the Chinese economy shows few signs of slowing, Bloomberg reported. Production at US factories, mines and utilities was unchanged last month, held back by a decline in energy demand, Bloomberg said. US housing start unexpectedly rose to a 21-year high in January, paced by record construction of single-family homes, Bloomberg reported. US lawmakers are beginning a new push to compel enforcement of a 1996 law imposing sanctions on foreign companies that do business in Iran, a move that might trigger a European Union protest to the WTO, Bloomberg said. The US economy has "firmed" and inflation is low, even with interest rates that remain "accommodative," Fed Chairman Greenspan said. The NHL canceled its season today after locking out players for 154 days, Bloomberg said. US Steel, Nucor and AK Steel rose on speculation that US steel producers may be acquisition targets for larger companies in Europe, Bloomberg reported. US 10-year T-Notes are falling the most in three weeks after Fed Chairman Greenspan made positive comments about the US economy, Bloomberg reported.

BOTTOM LINE: The Portfolio is higher mid-day on gains in my semi/software longs and internet shorts. I took profits in a short and a long this morning, thus leaving the Portfolio 100% net long. The tone of the market is mildly negative today as sector performance is mixed and the advance/decline line is slightly lower. However, most measures of investor anxiety are higher, small-caps are outperforming and economically sensitive groups are rising. The very strong housing report is a big positive and once again illustrates the staying power of this industry. The rate of homebuilding may be slowing, but should remain at very high levels compared to past history as long-term interest rates remain low, the labor market continues to improve and supply stays relatively low. I expect US stocks to rise into the close from current levels on optimism over US economic growth, strong earnings reports, short-covering and increasing fund inflows.

Late-Night News
Asian indices are mostly higher, led by gains in China. JP Morgan will hold an investors' meeting next week on its credit- and debit-card business, the Wall Street Journal reported. North Korea doesn't have the technology necessary to attach nuclear warheads to missiles, the Chosun Ilbo newspaper reported, citing South Korea's National Intelligence Service as telling a government committee. Below-average snowfall in the Pacific Northwest may lead to higher electricity prices later in the year, the Wall Street Journal reported. China's imports of steel products fell 41% to 1.92 million metric tons in January compared with a year earlier, the Beijing-based customs office said. Fidelity Management raised its stake in Infosys Technologies to 5.65% of the company's equity, the Hindu Business Line reported. Tractebel SA and Norwegian ship-owner Leif Hoegh ASA plan a $900 million project near Boston to import liquefied natural gas, Lloyd's List reported. South Korea's government won't agree to any significant economic initiatives with North Korea until the issue over its nuclear weapons is resolved, Bloomberg reported. Shares of Chartered Semiconductor Manufacturing Ltd. and STATS ChipPAC Ltd. rose in Singapore after Applied Materials said the outlook for the computer chip industry is improving, Bloomberg said. Doctors and scientists will probably tell the FDA this week that Pfizer's Celebrex painkiller needs to carry a tougher warning of a link to heart attacks and strokes, Bloomberg reported. Pfizer and Merck are among pharmaceutical companies that are likely to consider buying smaller competitors this year because of additional cash from a one-time tax break, the Wall Street Journal reported.
